Welcome to MyStor. By accessing or using the MyStor mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and MyStor.
Definitions
- "MyStor", "we", "us", "our" – refers to the MyStor platform and its operators.
- "User", "you" – refers to any individual who accesses or uses the App.
- "Customer" – a User who posts jobs or requests services through the App.
- "Provider" – a User who has been verified and offers services through the App.
- "Job" – a service request posted by a Customer, including its description, photos, location, and category.
- "Offer" – a proposal submitted by a Provider in response to a Job, including a price and estimated timeline.
Eligibility
You must be at least 18 years old and legally capable of entering into binding contracts to use the App. By registering, you represent and warrant that all information you provide is accurate, current, and complete, and you agree to keep it updated.
Account Registration
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use. We reserve the right to suspend or terminate accounts that violate these Terms or exhibit suspicious activity. You may not transfer or share your account with another person.
Provider Verification
Providers are required to complete identity verification (KYC) before offering services. This includes submitting a government-issued identification document and a selfie for identity matching. Verification is processed securely and data is handled in accordance with our Privacy Policy. We reserve the right to approve, reject, or revoke provider status at our sole discretion.
Platform Role
MyStor is a marketplace platform that connects Customers with Providers. We facilitate the connection but are not a party to the agreements between Customers and Providers. We do not employ Providers, nor do we guarantee the quality, safety, legality, or timeliness of services offered through the App. MyStor is not responsible for the actions, omissions, or conduct of any User.
Jobs and Offers
- Customers may post Jobs describing the work they need done, including photos, location, and category.
- Providers may submit Offers on Jobs with their proposed price and estimated timeline.
- Acceptance of an Offer creates a direct agreement between the Customer and Provider. MyStor is not a party to this agreement.
- Both parties are expected to communicate clearly, act in good faith, and fulfil their obligations.
- Either party may cancel a Job before work begins. Cancellation policies and any associated fees will be communicated through the App.
Payments
- Platform Fee. MyStor charges the Customer the platform fee shown in the App before the Customer accepts an Offer or paid site visit. Unless the App shows a different amount, the current default platform fee is 10% of the agreed job price, with a minimum of €2.50. No MyStor platform fee is deducted from the Provider's earnings for platform-fee-only bookings. This fee is collected at the time the Customer accepts an Offer and is processed through our third-party payment provider, Stripe. By using the payment features, you also agree to Stripe's terms of service.
- Direct Job Payment. Payment for the job itself is arranged directly between the Customer and the Provider. MyStor does not collect, hold, escrow, guarantee, or transfer job payments on behalf of either party. The method of payment (cash, bank transfer, or other means), payment timing, proof of payment, and any direct-payment refunds are agreed and handled between the Customer and the Provider.
- Visit Fees. Some Providers may require a paid site visit before giving a final quote. Visit fees are separate from the final job payment and are charged when the Customer accepts the visit offer. Visit fees are non-refundable after the Provider attends the scheduled visit, except in cases of Provider no-show or as determined through MyStor's dispute resolution process.
- Receipts, Invoices, and Taxes. MyStor provides transaction summaries for platform fees and payment flow only. These summaries are not invoices for services performed by Providers. Providers are responsible for issuing any service invoices, warranty documentation, tax receipts, and records required by law. Customers must request service documentation directly from the Provider.
- Refunds. Refunds of platform fees and visit fees are not automatic. Any refund request is reviewed and decided on a case-by-case basis by MyStor through our dispute resolution process, based on available evidence.
- Third-Party Fees. MyStor is not responsible for any fees, charges, exchange-rate differences, or issues imposed by your bank, card issuer, payment provider, or payment processor.
Reviews and Ratings
Users may leave reviews and ratings after completing a job. Reviews must be honest, factual, and based on genuine experience. Reviews must not contain hate speech, personal attacks, discriminatory language, or defamatory content. We reserve the right to remove reviews that violate these Terms, our community guidelines, or applicable law.
Prohibited Conduct
You agree not to:
- Use the App for any unlawful, fraudulent, or deceptive purpose
- Impersonate any person, entity, or falsely claim affiliation with any organisation
- Submit false, misleading, or inaccurate information in your profile, jobs, or offers
- Harass, threaten, stalk, or abuse other Users in any way
- Circumvent the platform to avoid fees or conduct transactions outside of MyStor
- Upload viruses, malware, or any content intended to compromise the App's security or infrastructure
- Use automated tools, bots, or scrapers to access, monitor, or copy any part of the App
- Solicit personal information from other Users for purposes unrelated to a Job
- Post content that infringes on intellectual property rights of any third party
Disputes
In the event of a dispute between a Customer and a Provider, both parties should first attempt to resolve the issue directly through the App's messaging feature. If a resolution cannot be reached, either party may file a formal dispute through the App's dispute resolution feature. MyStor may, at its sole discretion, review booking records, chat logs, timestamps, uploaded evidence, and platform-fee records, but MyStor cannot independently verify every off-platform payment, cash exchange, or completed service. Decisions made by MyStor during dispute mediation apply to platform-related matters only and are not a legal judgment.
Intellectual Property
The App, including its design, source code, logos, trademarks, and all content created by MyStor, is the intellectual property of MyStor and is protected by applicable intellectual property laws. You may not copy, modify, distribute, reverse-engineer, or create derivative works based on any part of the App without our prior written permission. Content you upload (photos, reviews, job descriptions) remains yours, but you grant MyStor a non-exclusive, worldwide, royalty-free licence to use, display, and distribute it within the App.
Limitation of Liability
To the maximum extent permitted by law, MyStor shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to damages for loss of profits, data, or other intangible losses. Nothing in these Terms limits any consumer rights, statutory warranties, or other rights that cannot be excluded or limited under applicable law.
Indemnification
You agree to indemnify and hold harmless MyStor and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the App, your violation of these Terms, or your infringement of any rights of another User or third party.
Service Availability
The App is provided on an "as is" and "as available" basis. We do not guarantee that the App will be uninterrupted, error-free, or available at all times. We may perform scheduled or unscheduled maintenance, updates, or upgrades that temporarily affect availability. We are not liable for any loss or inconvenience caused by downtime or unavailability of the App.
Termination
We may suspend or terminate your access to the App at any time, with or without cause or notice. Upon termination, your right to use the App ceases immediately. We will handle your personal data after termination in accordance with our Privacy Policy, including deletion within 30 days unless retention is required by law. Provisions that by their nature should survive termination (including limitation of liability, indemnification, and intellectual property) will remain in effect.
Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes through the App via push notification or by email at least 14 days before the changes take effect. Continued use of the App after the effective date constitutes acceptance of the revised Terms. If you do not agree with the updated Terms, you must stop using the App and delete your account.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Croatia, without regard to conflict of law principles. Any disputes arising from or related to these Terms or your use of the App that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the competent courts in Zagreb, Croatia.
